New York back to school · law-ready · preferred-source pathway

Free period products—without a long bid cycle.

Egal, Henson Sales Group, Creekside Industries, and NYSID give New York schools a practical path from Public Health Law §267 to free pads and tampons inside the restroom stall.

When an approved NYSID preferred-source offering meets the school’s form, function, utility, and pricing requirements, the purchase is exempt from statutory competitive procurement requirements.

New York Public Health Law §267

Free pads and tampons are part of the school restroom standard.

The July 1, 2024 amendment extended the requirement to qualifying non-public schools and clarified that menstrual products include pads and tampons.

Schools determine the types of products to make available in consultation with a school nurse, director of school health services, or another healthcare professional.

Who is covered

New York public and non-public elementary and secondary schools serving students in any grade from 6 through 12.

What schools provide

Menstrual products—including pads and tampons—at no charge to students in school restrooms.

How access is handled

Products must be available in a way that protects student privacy, including access through gender-neutral restrooms.

Creekside + NYSID preferred-source pathway

Take the bid process off the critical path.

New York’s preferred-source program advances employment for people with disabilities while giving covered purchasing agencies a faster route to approved products and services.

NYSID is the facilitating agency. Creekside supports the New York supply and fulfillment path. Henson helps schools and channel partners specify the right restroom program. Egal provides the products.

Preferred-source status is item-specific, not a blanket exemption for every product. Confirm the current offering and purchasing requirements before ordering.

01

Confirm the approved offering

Creekside and NYSID verify that the requested Egal configuration is on the applicable preferred-source offering list.

02

Match the school’s requirements

The products must meet the district’s form, function, and utility needs and the applicable preferred-source pricing rules.

03

Purchase without a competitive bid

Qualifying approved preferred-source purchases are exempt from statutory competitive procurement requirements, taking the traditional bid cycle off the critical path.
